Abstract. Starting from a rereading of a research carried out in the daily press in the 80s, it reflects on the structure of the new mass media, such as the web, to highlight the possibility that the same may repeat, as in the past, the problem of “contagion”. It is also reflected in the art. 580 c.p., also in the light of the recommendation of the Constitutional Court of 16 November 2018.
