AbstractThe case of the former mayor of Riace Domenico Lucano, sentenced on 30 September to thirteen years and two months imprisonment by the Court of Locri, leads, given the similarity with the «délit de solidarité», to a comparison with the French case, as well as to an examination of the problem in the light of European and International legislation concerning humanitarian aid.
In view of this, albeit with the caution dictated by the knowledge only of the operative part of the judgment, pending the legal justifications, it seems legitimate to express perplexity on the severity of the judgment, which has led to almost a doubling of the number of years imprisonment requested by the prosecutors.
