The criminal liability of the art dealer in light of the uncompleted examination of the bill (DDL S. 882)

Abstract. The aim of this paper is to analyse the illicit trafficking in cultural goods. After having investigated the problem in general terms, the position of the art dealer will be taken into consideration, highlighting the crimes attributable to his conduct and the consequence of the uncompleted examination of the bill (DDL S. 882).

This article was submitted anonymously for evaluation by two expert reviewers, with a positive outcome.

 

SUMMARY: 1. Illicit trafficking in cultural goods: the destruction of a population’s identity by the so-called “archeomafie”. – 2. The criminal liability of the art dealer who acts as an intermediary for criminal organization. – 3. The criminal liability of the art dealer who places a good of illicit origin on the market, concealing its origin. – 4. The nature of the relationship between art. 648 of the Criminal code and art. 176 of the Code of cultural heritage and landscape. – 5. Conclusions.
